情況如下: 我太太今年4月份公司幫申請h-1b並被抽中, 然後就用OPT Cap Gap 的extension工作,六月份收到RFE,八月份提交的response package. 我們問她公司律師,律師說她可以工作到直到收到h-1b的受理結果為止(我們記得隻能工作到9月30號,但沒深查)。 結果,10月15日收到h-1b被拒通知,在這之前她是在工作的。 後來我們對這律師的說法產生懷疑,上網查發現大部分律師說她這種情況隻能工作到9月30號的。 我們擔心她現在10月1日以後的這段經曆很麻煩,請問8老師怎麽辦來補救?
-Her legal work date was on 9/30/2014(F-1 expiration date) when the H-1 was pending, or was the H-1 denial date if the denial occurred before Oct. 1. Only if was her H-1 approved before Oct. 1, then she can continue to work after Sept. 30, 2014 as the H-1 status.
If she did not file change of status application before Oct. 1, then she has to go to China to get the visa to come
back as your dependent (e.g. H-4, F-2 visa, etc., depends on what status you have).
