H1B：1/26/14到期

去年到今年初回國兩個月，回來後律師1/23遞交了H1延期申請到3/30.結果收到RFE，詢問在前一次H1延期申請裏recapture時間的問題。原來豬頭律師把我在06年OPT和H1中間的gap回國的三個月時間也給申請recapture了。問題是USCIS之前已經把那三個月批了，批準到期日就是1/26/14.現在律師說暫時不回複RFE,法律規定隻要在之前過期之前交了延期申請，就視為自動延期，至少可以當作延期到3/30，希望PERM趕快批，然後交140，之後就可以再延期H1了。
-Had better response to the RFE and explain the situation and request the extension to the correct date, at least not hurt you to respond to the RFE.
請問，律師說的靠譜嗎？隻要不回這個RFE就可以當成自動延期了？
之後如果140批了，不會對以後的申請有不好的影響？
-As long as you get the H-1 extension and you get the I-140 approval before the extended H-1 expires,, you will be fine to file the H1 extension again beyond the 6 year H1 limit.
另外，老公準備EB2降級到EB3，重新交140，並同時交485，我應該可以同時遞交，對嗎？
-Yes.
如果申請EAD,就算H1過期了，也不要緊，對嗎？
-Correct.
如果我自己的H1到期來不及等到我的140批的話，我是不是應該在3/30之前交轉身份的材料？
-If you file I-485 before that date, you don't need to change your status. But you need to stop working until you get the EAD. Otherwise, you need to file change of status application if you can not file I-485 before you H1 expires.
還是需要離境？還是不用轉，因為在等485批？
另外，如果因為律師出錯而造成什麽後果，我是否沒有權利起訴，因為他隻和公司有雇傭關係？
