上次說我丈夫新H1簽證批準了，可是律師忘了給我申請新的H4，舊的H48月底就過期了，所以我現在屬於非法居留在美國。那我因為孩子小，在美國，我如果回國重新簽證，特別不方便。國內不是有通過中信銀行免麵談代簽業務嗎？
-Don't think you can do it because you are in US now. You only can apply for a visa when you are outside US physically no matter whether you apply for it personally or use 中信銀行免麵談代簽業務.


如果我把護照寄回國內，讓親友幫我辦理代簽業務，得到新簽證，這樣行不行？因為丈夫現在國內，他的新H1 approval notice 也在。
-Because your spouse is in China, there may be a problem for you to enter US independently from China unless you and your spouse enter US together (I am no very sure this, so talk to your lawyer). From my understanding, a dependent on H4 can be in the US if the primary person on H1 is abroad briefly for vacation. But if both of you are in China, the situation is different. If the primary person do not enter on H1,  a dependent trying to enter on H4 could be seen as immigration violation.          

另外我聽說不是什麽身份過期，在美國都有6個月的grace period 嗎，
-There is not such grace period for H-1 or H-4 like your case.


我這樣的能不能享有這樣的grace period 呀？
