今年是cap-based H1B的第7年, 重未出境申請過H1B 的 Visa stamp. H1B transfer到另外公司後由於 H1B 有GAP, 要出境拿簽證和I-94, 所以境外H1B簽證肯定背景調查, 估計要 3 - 6 星期.

請教這種情況下,
1. 我在收到 H1B application receipt後能不能開始在新公司工作 ?
-Unless you file H-1 transfer after your old H-1 I-94 expires, it is fine for you to work after you file H1 transfer. But if your H1 transfer is approved without I-94, you have to stop working and then, go to China to get the H1 visa. Another choice is to use EAD to work.
2. 然後，在收到H1B approval 後, 但在境外拿到 H1B visa 和 I-94 之前這段時間內能不能工作 ？ 還是要暫停工作, 一直等到境外拿H1B visa 並且入境拿到 H1B 的 I-94 後, 才能繼續工作 ?
