我和太太一直用 EAD上班，上個月新的485 (current company sponsored)遞上去，律師說要同時取消舊的485(pending more than one year)，那樣舊的EAD就沒用了，但新的EAD沒下來，這期間我們的身份是什麽？485 pending？我和太太都是合法工作嗎？謝謝。

-Both of you do not need to withdraw the old I-485, and USCIS will put all of your information (old I-485 and new I-485) together for consideration. The lawyer is terrible. Actually, you do not need to waste money to file a new I-485 and just send a letter to ask USCIS to do the I-485 interfiling/transfer. The lawyer really just wants more money and does not do the best way for you.

If you withdraw your old I-485, you can not use the EAD to work, but you can still stay in US legally based on the new pending I-485.
