485 pending question， 謝謝。

我和太太一直用 EAD上班，上個月新的485 (current company sponsored)遞上去，律師說要同時取消舊的485(pending more than one year)，那樣舊的EAD就沒用了，但新的EAD沒下來，這期間我們的身份是什麽？485 pending？我和太太都是合法工作嗎？謝謝。
