回複：請教：持綠卡，離境一年之內沒有返回，怎麽辦？

我先生去年12月份第一次拿到綠卡離開美國，原打算今年12月份返回，但天不遂人願，暫時不可能回來了；可能明年二三月份才能回來。並且他以後也不會每年長期在美國呆。該怎麽辦？

1。有人說拿著綠卡試試，看能不能近來？可行嗎？因為他來了一個月以後還要返回國內，我們不想進入繁瑣的移民法庭程序（I suppose it will be a long time procedure)。

-He may not be allowed to enter US by using the green card if he enters US after staying in China for > one year without any reason to justify this delay return.

2。直接放棄綠卡，申請旅遊簽證？

-This may be the better choice if he does not plan to stay in US permanently. Of course, he can apply for the green card again if he wants to live in US in the furtue.

這種情況是在北京大使館辦就可以呢？

-Yes.

還是必須到廣州大使館辦理？-Not necessary.

 

這兩個程序是同時進行，可能會在同一天辦理嗎？

-Yes.

據說可以換成一種B2簽證，十年可以免簽？

-I don't know how many years the B2 visa will be valid, case by case basis.

放棄綠卡的程序會很複雜嗎？-Simple. Just provide the completed I-407 and the green card to the US Consulate and at the same time apply for the B2 visa.
