Last year, I got an offer from company A and I got the approved H1B transfer (good until Sep. 2014) to leave my current company B. However, I didn't leave my company B, as it was about the time to file I-485.This year, I didn't renew my H1B with company B and just use my EAD card and my I-485 is pending for 180days. So I am thinking to leave company B. Company A still would like me to join and offer me another position.
My question is that, can I still use my last year's approved H1B transfer to work for company A? (I would like to change my status backto H1B because it is easier for travelling). I am not sure if last year's H1B transfer is still good for this year's position. The job decriptions for the two positions are very similar, but the job titles are different. What do we (me and company A) need to do for me to be able to use the last year approved H1B sponsored by company A? Filing an amendment?
-No you can not use the H1 approval any more because you have used EAD. So, you hav eto use EAD to work for the Company A. If you want to be h1 again, you can askk your new company to file an H1 petition for you and then, you go to China to get the H1 visa to come back.
