現在父母在國內，年底會過來，計劃到時候給他們申請綠卡。現在他們正在準備材料，結果在婚姻公證上遇到了問題。38年前結的婚，其實隻辦理了儀式，並未領證，這幾天補領了結婚證，當然對綠卡申請無用的。昨天剛去當地公證處問了，現在很嚴格，說國內新的婚姻法已經不承認事實婚姻，不讓辦理。請問大牛們，我們該怎麽辦？

Your case belongs to you were born before your parents' marriage occurred (illegitimacy).The immigration law recognizes a father/child relationship for a child born out-of-wedlock if one of the following is true: the country of the child's birth does not distinguish between legitimate and illegitimate children, a parent-child relationship was established prior to the child’s 21st birthday, or the child is legitimated before the age of 18.
So, you just need a certificate (公證) of the relationship between you and your father, your birth certificate and provide the evidences of emotional or financial connection between you and your father since your childhood. See I-130 Instructions Page 3, #4. So, you do not need your parents' marriage certificate. Of course, not hurt you also to provide the "這幾天補領了結婚證" though it is not helpful.
