Really can’t wait, have to go EB1. I have a pending I-485 (EB-2) filed in 2007 with PD of earlier 2007, bad luck, I didn’t catch a visa number for FY 2012, seems have to wait until the next FY 2013 starting from Oct.1. Really don’t know what will happen in that new year. So can’t wait anymore, now is going to try EB-1. But I have a serious question about my son, his I-485 was also filed in 2007 when he was less than 21 years old, now he is older than 21, if I get my new EB-1 I-140 approved, can I still file a new I-148 for my son based on my new I-140? Or re-link his to the old case? If yes, is there any way to find a formal document of USCIS to show this matter? I’m really nervous that my new application may bring any risk on my son’s status.
