我的h1b從2007年10月開始。2008年11月被layoff了。2009年5月份的時候有個offer。然後2009年6月回國，8月份境外激活新的H1B. 剛剛接了個offer，在辦h1b transfer. 現在的問題是, 這個recapture怎麽算？
新公司的律師說我在2008年11月到2009年6月之間不能算在recapture之內。我提供了layoff letter。上麵很清楚的寫著我在被layoff公司的最後日期。但因為我是2009年6月才回國激活簽證的，從11/08到06/09之間的日子不再美國境外，所以不能recapture. 是這樣嗎？
-You can argue with USCIS to recapture that period of time, but I am not sure whether you can get it because you did not change your status to another status or left US at that time to stop the H1 time running.
h1b到2013年10月就6年了，這次transfer h1b的時間上我沒有優勢。所以想能長點最好。
