2)我老公現在的公司正在給他辦H1B延期,如果他成功延期H1B 3年後再跳槽,跳槽後這延期的3年會不會廢掉。他跳槽後再延期來得及嗎?
-He can change noiw and do the H1 transfer using the approved I-140 for another 3-year H1 extension (beyond the 6 year limit) and had better use premium processing to get it approved in 15 days in case the old emploper withdraw the I-140. Then, ask the new employer to file PERM/I-140. Because he has 3 year H1 for the new employer, the time is enough to file PERM and get the I-140 approved. Then, he can use the new approved I-140 to extend his H1 untill he file I-485 or get the green card.
