My mom married again after my father died.

Now I want to get my mom and step-father to US and apply green cards for them. But my step-father can't come now.

My questions are:

1 Could I apply green card for them when my mom is in US and my step-father is in China?

-Yes, he can apply for the immigration visa in China. But if he married your mother after you turned 18 years old, you can not be qualifed to sponsor him green card (either in US or outside US).

If I could, what kind of material should I prepare and how to apply?

-If their marriage occured before you were 18 years old, you can file I-130 for him (indicate in the I-130 using consulate processing). Then, just wait the National Visa center to send you the instruction to provide other required docuemnts following the NVC instructions.

2 I heard it is easier to apply green card in US. So if my stepfather wants to get a B visa and comes to US.

-It is true.

What should I prepare for him?

-A inviation letter and completed Form I-134 (financail support for his travel).
