老公的485 current樂，但是公司說他的工資沒有達到prevailing wage,不讓遞交
我們就找外麵的律師辦，
外麵的中國律師給的sample EVL給單位簽字，local HR partner答應簽字了
但卻說要給regional HR看一下
這一看，regional HR回答說不能簽
因為我們的case就是不能遞交，如果簽字遞交了，就把他們公司put in risk (他們說這是misrepresentaion)
然後我問了現在的律師，我問他standard employment letter可以嗎？，他一開始說總比沒有強，
後來他的意思是可以隻交paycheck, W-2,那種standard employment letter也不要交了
我問這種情況成功率多少，他說一半一半吧，
-Agree with the lawyer. It is also OK to provide the recent-6 month paycheck stubs and the H1 approval notice with I-94. Of course EVL is better.
我真不知道到底要不要冒險阿
-Yes. He may file his I-485 now to see what will happen, then you can file yours later if eveything goes well. Thus, you can save some money if something wrong.
這個EVL一定要綠卡模式的還是standard letter也可以阿？
-Standard letter is also OK as long as it addresses his title, duties, salary and indicates the job has no definite term and he (your spouse) has the expectation to be employed continually. His current salary deos not matter that much because the prevail wage is the one after getting green card.
