8 teacher, here is the update for our re-apply H4 visa. We had in-person interview for a H4 visa on behalf or my adopted child recently and the visa officer had no questions to ask and only said the child is not eligible for a H4 visa based on American's laws.
-It is actually true because you have not lived together with the child for two years yet. If your child get the H4 visa, that is lucky. If no, it is normal.
We argued there is no such law for adoption related to nonimmigrant and we were not allowed to explain more and were dismissed.
Do you think we should try to apply a B2 visa immediately for the adopted child since we applied for a wrong visa category (H4)?
-Yes, your child can try B2 because the denial of the H4 visa is not due to immigration intent this time (different from the last denial). The h4 visa denial will not affect the B2 visa application.
