首先謝謝8老師這幾天耐心的回答我的許多問題。再把我的情況簡述一下:
EB2 with PD 3/27/2007. My original I140 has been approved in 2008 and the I140 amendment was approved this August after company merger. I submitted my I485 with RD 8/19/2011. My EAD/AP has been approved 10/11/2011. Now the company is closing the office. My current H1B will expire 1/8/2012 and the company filed my H-1B extension to VSC in august still waiting for approval.
現在已經得到公司的relocation offer,要去鄰近一個州的辦公室做同樣的工作,除了地點,別的沒有變化,但下一個月就應該去報道。在過去的兩周積極找工作,也得到同一城市另一公司的offer,做相似的工作。
我想請問:
1.對我這種180天不到的情況,即使同公司不同地點可不可以用AC21?
-Yes.
2.公司用的是fragomen,以我在過去幾年和公司以及律師打交道的經驗,律師一定會do everything by the book,而且HR的人有任何問題都會去征求和聽從律師的建議。現在律師認為in his opinion, I should be able to use AC21 portability for the relocation even before 180 days.而且我也知道公司發給了律師LCA amendment and portability initiation request。我想知道律師如果理解錯誤(有時候真希望有些律師在為客戶服務和掙錢方麵仔細選擇),
他給移民局通知我要relocation,然後申請用AC21 portability,是不是我的I485就沒救了?
-Your I-485 should be fine.
3.我已經找到一個願意為我辦H1的相似工作,而且在相同城市,這樣就不會和家人分開,我想請問若即使留在公司內部也會因律師的錯誤理解有風險,不知道和直接去新公司承擔不到180天的風險,那個更保險一些?
-The only different risk is that if you change employer before your I-485 pending is > = 180 days and your current employer withdraw the approved I-140, then your I-485 is void. But if you still work for the I-140 sponsor only in a different location, this will not happen.
