EB２廣告的新職位

如果我在當前的單位已工作超過三年。 現在單位願意幫我辦GC EB２。 律師說打廣告的新職位要與我當前做的職位不一樣。 我在當前的單位取得經驗也不能算。 是這樣嗎？
