In the 485 filing instructions, there are the following statements:
you are not eligible for adjustment of status if any of the following apply to you:
D. Your authorzied stay expired before you filed this application;
E. You were employed in the United States without USCIS authorization prior to
filiing this application;
F. You failed to maintain your nonimmigration status, unless your failure to
maintain status was through no fault of your own or for technical reasons;
unless you are applying because you are:
1. An immediate relative of a US citizen (parent, spouse, ...)
These three parts are confusing to me. My questions is: If one violates D and E, and is a spouse of a US citizen, can s/he apply for the status of adjustment? Is part D or E is more serious than "you failed to maintain your nonimmigration status"? What exactly "You failed to maintain your nonimmigration status" means?
