Thanks. I know you are right, but I guess the 485 instructions are not correct. Let's look at a concrete case: Assume I overstayed and am a spouse of a US citizen. Part F does not apply to me because I am a spouse of a US citizen. However part D does apply to me becasue there is on exception in part D. According the instruction, "you are not eligible for adjustment of status if any of the following apply to you", I have found the any, the part D, that applies to my, and so I am not eligible for adjustment of status.
So these instructions are problemic. Do you know what is the statement in the origianl Act?
