老媽4年前私自抱養了一個小孩，一直在我國內的家住，我們回去看過那小孩幾次，每次時間少於一個月，沒有共同居住夠兩年。最近費不少周折才辦下了收養證。本人是H1B,在辦收養證後一個月遞了485，現在485 PENDING之中。在文學城看了幾個收養案例簽H4成功的例子，我們也於10月中旬通過中信銀行遞了H4申請，之後先生有被請去麵試，然後又按要求補充了上幼兒園和幼兒手冊，上麵有我們國內的地址。我們還遞交了收養證的公證材料等材料。今天收到拒簽信，說根據214（b）不符合發給簽證的條件。

小孩一直跟老媽住，我們希望盡快把他帶來美國共同生活，擔心太大了管不住了。各位大師PJIANG,8老師等請幫出謀指點，拒簽的理由是什麽呢，簽B2有希望嗎？

-The visa officer said your adopted child has the immigration intent and thus, denied the child visa application. I think this denial reason is ridiculous. Based on The Immigration Act of 1990 which codified the doctrine of dual intent, the H1 or H4 visa is dual intent visa which allows the applicant have immigration intent and thus, the VO should have not used this reason to deny/refuse your child's H4 visa application. So, your child may try to apply for the H4 visa (not B2) again and may argue with the VO that the H4 visa is dual intent visa (allow the applicant have immigration intent). Your child had better get the interview with the VO. Contact the US Consulate whether your spouse can be allowed to accompany your child for the visa interview. If no, may use 中信銀行 again but provide a letter to argue the denial reason.

The following is the 214(b):

Section 214(b) is part of the Immigration and Nationality Act (INA). It states:

Every alien shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for admission, that he is entitled to a nonimmigrant status...
