各位老師,EB2 6/2007, 剛剛提交485. 現在公司給辦H1延期(明年1月到期),發現問題.09年時(140已批)總公司給我們公司換了個名字和稅號,但工作內容要求和地點一切不變.當時問公司HR是否要H1 AMEND 和影響綠卡,HR說不影響(說老公司還是我的legal employer, 好象總公司想讓老的公司名字慢慢的退出),
-It is true that H1 amendment was not needed at all unless your job responsibilites are changed substantially.
就什麽也沒做.
現在要H1延期,公司律師講要AMEND AND EXTENSION並用加快 (不知他們09年為什麽沒有發現這個問題).
- If the H1 amendment at this time is used one I-129 together with the H1 extension, that is fine and not need premium processing if the fee is paid by you. If the lawyer uses one I-129 for amendment and another I-129 for the h1 extension, that is ridicular.
我485律師是自己找的.
這月初485提交時還用老公司的名字.我的485是否就有問題了?

我是否有successor-in-interest保護?

是否晚點交或不交H1延期,希望485就批了或用EAD if possible?
-Up to you. The H1 extension has to be filed before your current H1 expires. You can also choose to use EAD, not extend your H1.
還是盡快重新辦PERM(痛苦啊).
