First I feel very very sorry for your case. Persons struggle here for a better life. It is not easy.
Second, my suggestion is, since your attorney is filing appeal for you, you should be ok now. To make sure, please ask your attoyney whether your current status is ok when you are waiting for appeal.

The worst case, if you are really out-of-status, you can go back to China and apply for H-4. You will have no problem to get H-4 because H-4 permits immigration intend. So, the VISA officer will give you the visa.

It is not the end of the world. Head up and move on.
