It is highly likely that I am getting an offer from a public school district. The manager told me that the latest day she wanted the incumbent to start is July 20th. In the email, she said: I put July 18, 2011 as the hiring date. Please note that July 18, 2011, not be the actual start date.  Everything is contingent upon your clean background check and a complete application.Does this mean she might be flexible? Oct 1st?

-Not mean that. Background check is a regular procedure for any employer and it may only taker a few days. If you do not have any criminal or immoral record that prevent you form the hired position, the employer will give you the offer letter shortly.

   I checked myvisajobs.com and found out that this public school district sponsored four H1-B visa since 2007. Does this indicate that this school district will do J visa?

-NOt that mean, but the school may also be qualified for J1 sponsor, but you need to contact the school HR for this information. But H1 is much better than J1 if the school cab provide the prevail salary for H1.

 

   My OPT has already expired. So, I have to go back to university to maintain my F1 status. I am not positive that this university will issue a CPT for me. If it does, things are perfect. If not, may any of you give any suggestion about what to do?

-If this school is a high school, the H1 is cap-subjected and thus, you do not need enrol the school, but just ask your school International Student Office where you just graduated to issue you a new I-20 to extend your OPT to Oct. 1 and put the OPT extension information into SEVIS after your employer files the H1 petition. Please note that this OPT extension does not need to USCIS approval, but only need a new I-20 and put it into SEVIS because it is based on Cap=Gap rule. But you need to provide the H1 petition filing receipt to your school for the OPT extension. Anyway, talk to your schooll after you get the H1 filing receipt. 

   I missed one job opportunity a month ago. The university doesn’t do H1B sponsorship. Instead of talking with the hiring manager, I talked with HR. This potential manager told me this: For information about background checks and other questions (salary, benefits, etc.), contact our HR Department” Who do you suggest to communicate with? HR or the hiring manager?

-Talk to the HR Director for the H1 filing after you get the job offer.
