回複：緊急求助, I-131 RFE

問題1: 移民局可能猜到或知道我妻子先出國後交 AP I-131 Form 申請, 請問這是否違法?

-This AP application (I-131 filing) is invalid. Just tell USCIS (response to the RFE) that your wife has left US and then, USCIS will deny the I-131.

 

問題2: 移民局要護照各頁, 恐怕先出國這事是瞞不住的, 是否要如實告之?

-Tell the truth and then, no any negative effect. YOur wife needs to get the H4 or H1 visa to come back if her status was H4 or H1 before sahe left. Otherwise, her I-485 will be invalid and she may not get the B1/B2 to enter US due to immigration intent.

問題3: 第1條, 第4條沒問題, 第2條可讓妻子把護照各頁複印寄來,  第3條I-94表, 過去的幾張有複印件在, 但最近一次的I-94表 (2009-12 issued) 3月23日出關時交回航空公司了, 沒留複印件, 不知怎麽辦?

 

問題4: 我們的綠卡是職業第二優先, 優先日是2006年4月20日, in current. 估計也快審批了, 這事是否影響,  懇請pjiang,8大俠賜教為謝.
