請問小白兔和86, 關於Reentry permit 的事,我現在自拿到綠卡起以在已在美國呆了5年多,完全符合申請公民, 但找到一國內工作(嚴格要求不能是外籍人士),所以我想在我回去工作的時候保綠卡,(我在美國沒有房產,隻有一姐姐在美國)
1)我是不是該申請 RP?
-You have to apply for the RP if you want to stay in China continuously for more than 1 year and less than two years. You can come back to US to apply for another RP before the first one expires. So, totally you may can stay in China for three to four years. If you do have RP and you stay in China for more than one year, your GC will be cancelled.
2)申請RP我基本就能夠得到RP批準嗎?
-Noramlly it should have no problem.
我想在中國呆3-4年.
3)若3年後我在回到美國工作(比如2014年我回來),我又想申請公民了,那麽我前麵已經呆夠了的那5年還算數嗎?
-No. Your physical presence will be zero.
還是又得從2014年再等5年??
-Only need four years because you can use the last year of the presence in China as the physical presence in US based on the immigration lawyer.
