先生是H1B的身份，先在要做H1B延期（目前的到7/31/2010過期）。之前問幫我們申請延期的人，她說隻要在7/31/2010之前寄出就可以，叫我們不要著急。昨天才讓我們將文件給她，

可她今天卻說現在申請H1B延期要先得到勞工部的批準信才能申請延期。可是我們現在沒有勞工部的批準信，再說以前也沒有聽說過什麽批準信呀？
-Your employer/lawyer needs to get the prevail wage determination online in one minute. Ask her not to file this prevail wage determination by paper filing (by mail), otherwise you will take about two months to get it approved (seems she is stupid, so I have to remind you to tell her about that). After she gets the prevail wage deternimation online, she needs to file LCA application online which normally takes one week to be approval. After she receives the LCA approval notice, she can file the h1 extension petition for you.

It seems you have run of time, so your H1 may approved without I-94. if so, you need to go outside US to get the H1 visa to come back to activate your H1 status. So, I suggest you to use premium processing to get the H1 petition approved within 15 days and thus, you can see whether the approval has I-94 or not.
