Question is,
1 .If the H-1 transfer petition Receipt Notice arrives later than the starting date set in I-129, is it still legal for me to continue working for the current employer beyond the starting date set in the H-1 transfer petition to work for new employer?
-Yes, you can work for your current employer until the I-94 expires if you and th employer want to. You also can work for the new employer after the transfer petition is filed (not need to get the receipt, if the check is cashed, it will be OK to work).
2. My I-485 is pending and not current. If I receive a RFE for Employment Verification before my H-1 transfer gets approved,how to explain to USCIS my employment authorization at new employer without a I-797, Approval Notice?
-The job offer letter form your new employer is enough to prove your employer status for the RFE.
