I haven't been working for about 10 months now. My old H1b ending date is 2011. I am now back on F1 since I was laid off.

Now I am talking with this new employer about a job. I asked them to transfer my h1b since it is supposed to go through 2012. But they told me since I haven't been working, my H1 is out of status and can't be transferred.
-It is not called H1 transfer because your current status is not H1, but F1. You just ask the employer to file the H1 petition (I-129) for you to change your F1 status to h1 and that is all. Because you had been h1 status before (assume you worked for a industrial company before), you do not need to get a new h1 quote, and that means you can work for the employer after the h1 ptition is approved. Use premium processing to get it approved within 15 days, if necessary.

If that's the case, does it mean my old H1b is useless now? For me to work again, do they have to apply for a new H1b for me?
