I cannot work until Oct 1, 2010 even though I got H1B approval. I am applying for 2011 quota. So, in this case, I may have more risk if I apply H1B visa with USCIS approval notice compared to just stay in the US.
-Not risky because even if your H1 petition is approved, your current status (e.g.H4) is still valid until Oct. 1, 2010 when the H1 status becomes effective.

But it is up to you anyway.
