回複：急問pjiang小白兔老師, 用AP入境後485被拒,如何重新激活H1B?

請問pjiang小白兔老師及各位,我的情況和昨天agu同學的情況很相似,都是本來有H1B,可用AP入境後因為485 RFE沒收到而485被拒,導致既沒有EAD也沒有H1B

.現在公司支持我回國重新激活H1B.可有幾個問題想先請教您:
1. 我原來的H1B上的A#與剛剛被拒的485是一樣的.這樣的話簽證官是否會查到我的485被拒而直接拒H1B呢?

是否應該讓公司準備新的I-797?
-It is not necessary if your current H1 I-94 does not expire yet, but up to your employer.
2. 公司律師準備在我回國簽證前火速遞交新的Eb1-b,可是目前我沒有任何合法身份.
我是否需要建議公司等我的H1B被激活後再提交?
-Not need. After you used AP, your employer still can file an H1 extension petition to re-instate your h1 status when you are physically present in U.S.
3. 公司律師說無法在美國境內激活H1B而必須回到中國,可我看到您博文中有好幾處提到"境內激活"的說法,
-I do not think it will be a problem for you to re-instate your H1 by h1 extension if your current H1 I-94 does not expire. Also, you can just go back to China to get an H1 visa to come back to re-instate your h1 status.

能麻煩您解釋下我的情況是否/如何能境內激活?
