長達近兩年的等待終於回到了原點。這裏share一下我的經曆和教訓。
Denial reason #1:
"The notice of filing submitted by the employer contains a wage of $$$$$$,
which is lower than the offered wage of $$$$$ listed in item G.1 on the ETA
Form 9089. Because the employer offered a lower wage on the Notice of
Filing less favorable than that offered to the foreign worker, this
application was not certified."
這一條是律師把prevailing wage寫到notice上去了。DOL要的是exact salary offered
或者是一個range with the minimum amount no less than the prevailing wage. 不
知道是不是typo, 律師提供的notice的草稿上寫的offered salary到終稿上就變成了
prevailing wage number.
Denial reason #2:
"The Notice of Filing does not contain the name of the employer."

收到denial notice後可以appeal, 但是考慮了以下幾點後employer放棄了appeal:
1. 張律師未征求我以及我的employer的同意就自行在一個中文報紙上登了廣告。公司
後來另外雇用的移民律師（一個大firm的partner)認為這樣在ethnic newspaper上登廣
告如果再被auditor質詢的話很難justify。
2. 對於appeal的過程，我谘詢了張律師： a.當我跟她谘詢能否後來withdraw的時候，
她很肯定地通過書麵告訴我appeal可以隨時withdraw; b.當我問起appeal的兩種類別（
普通appeal和針對政府處理錯誤的appeal)的時候，她聲稱可以先file appeal based
on government's error. 這兩點我和HR跟公司的律師求證均得到完全相反的回複 -- a
. appeal一旦under review 就不能withdraw; b. 我的case不能按government error
appeal.
3. 公司的移民律師找到相對應的previous case確認了denial reason #2成立, 同時認
為denial reason #1也成立(BTW, 當我先在電話中被告知case被拒的時候，張的
assistant沒有告訴我denial reason #1，直到後來我跟她要一份denial letter的scan
我才看到了#1)。所以最後她認為appeal成功的chance非常非常低。
最後，公司考慮到appeal可能又會耽擱數年，無法中途withdraw，而case本身又不是很
solid，基於我的best interest決定重新file新的application.
中間還有一些問題，我已經跟District of Columbia Bar file了 complaint。具體細
節在得到formal resolution前就不好披露了。
到現在為止從張律師方麵我沒有收到任何道歉。她認為她已經"make every reasonable
effort"而且"have been lucky to get good results."
我得到的最大的教訓就是如果沒有很強的reference的話還是要找client比較多的事務
所 -- 經驗豐富就不容易犯低級錯誤。 PERM本來是很簡單的一個事情，所以以前很多
不是那麽周密的application可能都通過了，但是現在被人用放大鏡檢查就出問題了。
有經驗的律師事務所的操作應該就相對比較經得起推敲。律師那邊的一點粗心卻可能對
申請人造成巨大的傷害，而從一開始的一兩次見麵真的很難判斷一個律師的專業程度，
畢竟這種會麵都是經過仔細設計演練過的。
以上是我的一點經曆，希望對其他準備申請的朋友們有一些幫助。也算是存個檔供找律師的人參考。
