怎樣才能讓老婆，孩子順利返美？

本人一家當前身份 AOS。雇主已明確不給H1b。LP無專業，也不可能獲得H1b。

本月20號前，我還持H1b，LP H4（有效期從2008年2月8號至2009年10月20號）。10月20號之後，我將持EAD繼續為原雇主工作，原雇主不再為我延H了。

9月15號，LP緊急回國，帶著一個1歲半的孩子。他父親10月2號去世。情急之下沒有辦AP。喪事之後，LP立即預約廣州，希望能趕在10月20號之前回美。LP10月15號麵簽，順利通過。但直到21號才拿到簽證。沒想到，上麵竟然寫著：簽發日期：10月19號，過期日期：10月20號。

現在好了，H 沒有了(out of status,原雇主不給再延）， LP 也過不來了。更要命的是，我這裏還有一個3歲大的，每晚哭著要媽媽。

請問：像我這種情況應，如何才能讓老婆孩子盡快返美？



附：綠卡申請情況介紹
我的 I140（EB1a)在2007年9月就批了。I485沒有和140同時遞，485的received data 是07年8月17號； notice data 是 07年10月16號。盡管是EB1a，485卻趕上了大放水。因此到現在也沒綠。

Texas I485 的平均審批時間是 23.9 個月 （Texas Service Center - 23.9 Month）。而我的case已足2年了。
