遞交 I-485 EAD AP 申請求助!

我的 I-140 EB1A 九月份剛批準。我目前是H1B.
太太目前是F1, under OPT, 現在在國內，F1續簽在九月已經拿到，機票定在11月初返美國。
太太的OPT將在 Jan. 20, 2010 過期， 她的OPT是12個月，無法延期。她去年OPT生效前已經用了55天的grace period.
我準備等太太11月初回來後， 和她一起遞交I-485.

現在有幾個問題:

1, 太太11月初用 F1 入境美國會不會有困難? 她的OPT將在 Jan. 20, 2010 過期.

2, 太太入境後，律師建議等幾周 (6 weeks) 後再遞交I-485. 下麵是律師的建議，是否有必要?
"When someone comes into the USA in one status and then immediately switches to another status, they could deny the second status, saying that they committed immigration fraud by lying about their intent on entry.
The safest way is to wait about 6 weeks after entry and then file. However, for this type of situation for EB-1 I have never had that problem. Just letting you know. I would wait a few weeks, however"

3, 如果我們在12月中旬（太太入境6周後）遞交 I485 (including EAD, AP)， 明年1月20號前 EAD, AP能否拿到?
如果沒有拿到EAD和AP, 我太太還能否繼續在美國等EAD, AP？ 還是必須回國等EAD AP 批準?
有沒有其他辦法繼續待在美國? 轉身份為H4? Emergency AP?

請大家給些建議。
