我現在J1的收入是免稅的,如果申請H1B,聽說是要交稅。
那麽我的老板或係裏是不是得給我加工資啊?
-Yes. Based on the immigration law, the employer has to pay your salary at the prevail level, otherwise USCIS will not approve the H1 petition if the professor pay you lower salary.
要不然,依照現在的工資水平,再交稅的話,收入會縮水。一旦加工資,他們(係裏或老板)豈不是很不情願?維持我的J1身份對他們似乎更有利。
-That is true. That is why the professor does not want to support the visiting scholar H1, but give the scholar J1 status.

By the way, J1 waiver is not difficult if your salary is paid by your boss, not Chinese Government. Also, you can apply for green card now (filing I-140) using NIW or EB1A category if you want and your qualification is good. Then, after one year later you can apply for J1 waiver and then, file I-485 to get the green card after you get hte J1 waiver.
