急！！！這種情況申請綠卡需要補做J1 waiver嗎

01年留學歐洲，03年1月從歐洲申請來美，當時在歐洲美國領事館拿的是J-1簽證，並且有 2 years Foreign Residency Requirement的限製。



2003年9月交換實習後，我們回到了歐洲繼續讀本科。 並於2005年7月在歐洲完成了本科學曆。



2005年8月我們再次從歐洲申請來美國攻讀碩士，拿的是F-1 簽證，（在歐洲使館簽證時，工作人員在我們以前的J-1簽證上蓋了一個大章：（canceled without prejudice）



2007年4月，我們在美國碩士畢業後，找到工作，轉為H-1（EB3)工作簽證。



2007年7月我們遞交了I-140申請綠卡。



2009年3月我們的I-140順利通過.



目前I-485 pending, 由於我們2003年第一次來美國時的J-1簽證上有2 years Foreign Residency Requirement的限製，我們很擔心在申請綠卡時會有麻煩，但律師跟我們講由於我們已經用不同的身份，F-1簽證入美，並且又取得了H-1簽證，這就說明J-1的身份已經結束了，在申請綠卡的時候不會有影響，這是否屬實？這種情況是否還需要在做J-1waiver, 我們的I-485 已遞交，現在補做waiver是否來得及？
