１）我的I-94目前還是在有效期內，而且out of status是小於１８０天，這種情況下，向移民局遞交transfer 申請，應該是會批準的，對嗎？（記得網上看過一篇文章說今年移民局對有gap的申請放寬了一些）
-Yes, but Most likey the application will have no I-94 card and thus, you need to go out o U.S. to get an H1 visa to activate your H1 status.

２）要出境申請h1b visa 的話，是不是可以去墨西哥或者加拿大呢？

３）如果一定要回中國簽證，可否可以不在戶口所在地所屬的領館申請，因為時間緊急，想著哪個領館能預約上就去哪兒簽。

還有這種情況可以去美國駐香港領館簽嗎？

剛才公司的hr lady打電話來說，律師希望我盡快離境去簽證，我和她說我必須等到h1b transfer approve後發給我新的I-797才可以走，因為沒有I-797number,我連簽證預約都沒法約，大家說我給的這個理由充分嗎？
-You are right. You had better get the approval notice beore you leave U.S. If you are lucky to get the I-94 with your approval notice, you do not need to go out o U.S. and just go to work directly. Anyway, you had better use premium processing to get the H1 transfer petition approved within 15 days.
