urgent! help please.

Hi,

I am laid off today. Currently I am holding H1B which will expire 9/30/2009.
485 application is submitted in July 2007 based on my spouse's job. I applied EAD in 2007, but never use the card. The 1-year EAD card expired last year.
My questions are:
1. Am I out of status today?
2. I do not want to apply to change to H4, can I apply EAD directly now?
3. If I apply EAD, before I get the card, am I counted as out of status?
