H1B layoff, 辦niw的問題，懇求高手指點迷津

我在準備遞交niw申請前夕被laid off，不知道我還能不能申請niw。據說在申請時隻要有“工作意圖”就可以，而不一定要有工作，不知道這種說法對嗎？另外我什麽時候可以申請EAD？是不是必須140批了，485交了以後才可以？假如有了EAD以後，我還需要H簽證嗎？另外EAD是不是也不一定能被獲準的？

跪求高手們能解答一二阿。無限痛苦中。。。
