請教Pjiang老師: transfer H1 from non-cap to cap

If on April 1, 2009 LG submit H1 transfer from non-cap to cap, and he want to work in the company B (cap) since the notice day (say April 10). If he get approved transfer H1 on Aug. 2009 (i think the beginning time is Oct. 1). Can he still work in company B after getting approved H1? Can he stay in USA since approved time? Thanks. I am confused with the situation.
