According to interpretation this year, if his H1 cap petition received between Apr 1 to Apr 7 and got selected (secure a H1B cap number), he could start working for this cap company until the H1B petition is approved. But he needs to stop after H1 is approved and re-start after Oct 1. I know it's strange, but it's the USCIS interpretation. So exactly as what you stated for this non-cap to cap case. Whether next year will be the same, it will depend on whether USCIS/USICE will do the same again. If his new I-797 comes with H1 I-94, he can stay in US to re-start Oct 1.
