AD is the matter of bussiness. Biz can do whatever in the AD to recruit people. It is not regulated by DOL. DOL only take conservative side of AD when they process your PERM application. Biz can revise the job requirement over time. Again, I donot know there is something disallowing biz to revise job requirements. If you want to find some regulations to support, I donot know how to do so.
What I can say is that you got a very picky lawyer.
