The regulations do not provide for an appeal to this decision.

My I-485 case had been denied for more than 30 days already as I couldn't do the reopening without any new evidents.

But I am going to file a reopening request without Form I-290B, and also give CIS the fee, $585.

My attorney said that it is a gray area, so I have to be CREATIVE. :))))
