You need to take a look at your approval notices first.

Your current H-1b on I-797 expires in May, what is validity on your next H-1b on I-797? Is it I-797A or B?

Generally any period between validity of 2 H-1b, will constitute a gap.

Normally 10 days are given to leave the country upon termination of H-1b status.
