請大家幫忙指點一下身份問題

本人現在是H1B.今天剛遞了h1-H4的申請。被告知要5個月才能批下來。我的問題是：
1． 我現在可以辭職嗎？還是要等到拿到收據？多久才能拿到收據？
2． 如果現在可以辭職，那我的身份是不是H4 pending? 如果pending 5個月對將來申請綠卡會不會有影響(如out of status for 5 minths)? 請問有何法律規定嗎?
