Want to confirm, whether I can apply for AP.

I ted my 140 NIW /485 before 10/1,and my 140 is approved. I am still on H1B.

I want to go back home later this year, so I need to apply for AP.

Since EB2 is not current for me yet, as I understand I can still apply for AP under my pending 485, right?

One of my lawyer friends said no, because the visa number for NIW is not current for me, thus I cannot apply even for AP. I am confused, little cute rabbit and radiaology and other bros sisters, can you give me a definite answer?
