485 收到 RFE H1B

請問我的485 收到 RFE， 要我提供從2001年7月起至現在的有合法身份的證明，我才想起來從2001年7月被layoff(was H1B at that time) 到2001年10月才又在新公司辦的H1B， 請問會不會因為這三個月不給GC？
