You company must have sent a layoff notice letter to CIS. Or else, when you filed new H1-B, the paystub was too old. Thus they know you were laid off.
My friend once told me that, as long as CIS approved your old case (H1-B), usually they will not charge you for your old time out of status.
How did CIS know you were laid off.
