It is in NY.

Not sure about situation in TX.

You can just file to pro se office of the court, if they can take it, then there should be no problem.

If you are not at fault, then just go ahead to file WOM after you think you have consumed up all availabe adminstrative means to get the issue resolved. You must collect all the related evidence to support your complaint.
