xiaobaitu, mytwocents, and other expertises please help!

查了以前的帖，但沒能查到想要的答案。隻好請問各位好心人以下兩個問題。
背景：先生是H1B(his H1B will expire in January of 2007, but he will get it extended to 2010 soon this year), I140 已通過,現在是485 pending.我們想用 AP 回國一趟，4年多了，來了之後就沒回去過。我的問題是：如果我先生用了AP,回美後他任在同一公司工作，他的 H1B 還有效嗎？我的意思是,他是不是必須要重新延期才能繼續使用他的H1B身份？（我看到有的帖子說一旦使用了AP身份就變作AOS 了.如果是這樣的話，今年延期就白延了）。
我的身份是H4, 有工卡但沒用過.我的H4明年1月過期. 我的第二個問題是:我需不需要延期?如果不延,過了明年1月,我又沒有使用工卡，我的生份是不是就黑了?
