Most medium and big company probably won't do tax reteun net asset amendment as it creats too many hassles. Usually small private company would do that. So you should take this into consideration before talking to your CEO.

Your lawyer should know what criteria USCIS uses to adjudicate I-140 when it comes to ability-to-pay.

Besides, your company should show its ability-to-pay from your PD. So even if your salary gets raised to the LC wage now, your company still need to prove the ability from PD to now.
